The terms and conditions contained herein limit the acceptance of buyer's order.
Guard Dog objects to any different or additional terms and conditions in buyer's order.
If buyer finds any of these terms and conditions unacceptable, buyer must notify Guard
Dog Moly Lubricants, Inc. promptly in writing.
PRICES: Subject to change without notice. Guard Dog will not accept changes
to orders once accepted unless given and acknowledged in writing.
INVOICE TERMS (DEALERS AND INDUSTRIAL CUSTOMERS): Net 30 days from the date of our invoice. Buyer's must date its
payment on or before 30 days after the date of Guard Dog's invoice. Guard Dog will
access accounts payable over 30 days with an interest charge of 0.75% per month (30
days).
OPEN ACCOUNT: Subject to Guard Dog's approval of credit. An application for credit
requires the full name, address, name of a person, and telephone number of four
suppliers who provide a satisfactory credit record.
MINIMUM ORDERS: None for consumers. Case quantities for dealers in order to qualify
for a dealer discount.
SHIPPING/DELIVERY TERMS: Guard Dog ships orders by U.S. mail or "ground" parcel
service to buyer's "ship to" address, and Guard Dog investigates buyer's claim for non
receipt. Guard Dog may ship registered for its account. Buyer will be responsible
for the additional cost of shipping if requesting expedited methods of shipping.
WARRANTY: Guard Dog warrants products to meet published typical observations and
used according to instructions. Guard Dog neither gives nor implies any other
warranty.
RETURN POLICY: Telephone Guard Dog and explain the circumstances within two weeks
from the date of Guard Dog's invoice. BUYER MUST RECEIVE A NUMBER FROM GUARD DOG
BEFORE MAKING A RETURN. Guard Dog will refuse to give credit for products
unacceptable for resale. Guard Dog will charge 15% of the invoice for a restocking fee
for returns unless Guard Dog has created the reason for the return.
SALES TAXES: Guard Dog charges for Texas sales tax for shipments made within the
State of Texas unless Guard Dog has a Resale/Use permit on file from the buyer.
LIMITATION OF LIABILITY: Guard Dog disclaims any liability for consequential and
incidental damages beyond replacement of products shipped if an investigation showed
responsibility on the part of Guard Dog. Guard Dog's liability in all events is
limited to and shall not exceed the purchase price paid.
CONTROLLING LAW: The laws of the Sate of Texas control the validity, construction
and enforcement of the purchase agreement between Guard Dog Moly Lubricants, Inc.
and the buyer. In the event of a dispute arising out of this agreement, the buyer
consents to the jurisdiction of the federal and/or state courts located in the County
of Harris, Texas, United States of America. The buyer consents to service of process
by United States mail at the billing address and waives any objection to venue.
